Please read these Terms and Conditions carefully before making a booking, entering the venue, or using any services provided by CBR Badminton.

By making a booking, entering the premises, using our facilities, attending an event, participating in a program, purchasing products or services, or otherwise engaging with CBR Badminton, you confirm that you have read, understood, and agreed to comply with these Terms and Conditions.

If you do not agree with any part of these Terms, please do not make a booking, enter the venue, or use our facilities or services.

1. About These Terms

1.1) Application

These Terms apply to all customers, members, visitors, players, spectators, coaches, contractors, organisers, parents, guardians, children, and any other person entering or using the CBR Badminton premises, booking system, website, programs, events, or services.

1.2) Scope

These Terms apply to, but are not limited to:

  • Casual court bookings
  • Permanent or recurring bookings
  • Memberships
  • Coaching programs
  • Social sessions
  • Competitions and events
  • Private bookings
  • Group bookings
  • Venue hire
  • Equipment hire
  • Retail purchases
  • Online bookings
  • Walk-in services
  • Use of the CBR Badminton premises and facilities

1.3) Updates to These Terms

CBR Badminton may update, modify, or replace these Terms from time to time. The latest version will be made available on our website, booking system, or upon request. Where changes are material, CBR Badminton will take reasonable steps to notify customers.

1.4) Acceptance of Updated Terms

Your continued use of CBR Badminton's facilities or services after the updated Terms take effect constitutes your acceptance of those changes.

2. Management Rights, Entry and Service

2.1) Safe and Respectful Environment

CBR Badminton is committed to maintaining a safe, respectful, inclusive, professional, and enjoyable environment for all customers, staff, coaches, players, spectators, visitors, and members.

2.2) Management Rights

Management reserves the right to refuse entry, refuse service, remove any person from the premises, suspend access, cancel bookings, terminate membership, or deny future bookings where reasonably necessary for operational, safety, security, customer wellbeing, property protection, staff wellbeing, or venue management purposes.

2.3) Refusal, Suspension or Termination

Entry, service, bookings, or membership may be refused, suspended, or terminated where a person's conduct does not meet the standards expected by CBR Badminton, including but not limited to:

  • Abusive, threatening, aggressive, harassing, discriminatory, dishonest, unsafe, disruptive, or inappropriate behaviour
  • Failure to follow lawful and reasonable directions from CBR Badminton staff or management
  • Breach of these Terms
  • Prior misconduct
  • Outstanding debts
  • Misuse of the booking system
  • Unauthorised commercial activity
  • Unauthorised coaching or training
  • Damage or attempted damage to property
  • Behaviour affecting staff, customers, players, spectators, neighbours, or the proper operation of the venue

2.4) Right to Refuse Entry

CBR Badminton reserves the right to refuse entry to any individual where reasonably necessary in accordance with these Terms.

3. Opening Hours, Pricing and Availability

3.1) Current Information

Opening hours, court availability, pricing, programs, and services may vary from time to time. Customers should refer to the CBR Badminton website, booking system, or official communication channels for the most up-to-date information.

3.2) Changes to Pricing and Availability

CBR Badminton reserves the right to adjust opening hours, court availability, pricing, membership rates, program fees, and booking conditions at any time.

3.3) Confirmed and Paid Bookings

Price changes will not affect bookings already confirmed and paid, unless there has been an obvious error, system error, misuse, or unless otherwise required by law.

3.4) Priority Access

Priority access, pricing, court allocation, booking windows, events, programs, or selected sessions may be offered to members, approved groups, coaching programs, competitions, corporate partners, or other selected sessions at management's discretion.

4. Court Bookings and Payments

4.1) Advance Booking and Payment

All court bookings must be made and paid for in advance through the CBR Badminton booking system, unless otherwise approved by management.

4.2) Customer Responsibility

Customers are responsible for checking all booking details before confirming payment, including:

  • Date
  • Time
  • Court number
  • Duration
  • Price
  • Booking holder details
  • Number of players or attendees
  • Any applicable terms or restrictions

4.3) Staff-Assisted Bookings

CBR Badminton encourages customers to use the online booking system to avoid human error. If staff assist a customer with making a booking, the customer remains responsible for verifying the details before confirmation.

4.4) Availability and Approval

All bookings are subject to availability and approval by CBR Badminton.

4.5) Modification or Reassignment

CBR Badminton may cancel, modify, or reassign bookings where reasonably necessary due to operational requirements, safety concerns, maintenance, events, coaching programs, competitions, system errors, payment issues, or other venue management reasons.

4.6) Venue-Initiated Changes

Where CBR Badminton cancels or materially changes a confirmed booking for reasons unrelated to customer misconduct, CBR Badminton will take reasonable steps to offer a suitable alternative, account credit, refund, or other remedy where appropriate and where required by law.

5. Bookings Are Non-Transferable

5.1) Non-Transferable Bookings

Bookings are non-transferable and must only be used by the booking holder and their invited playing group.

5.2) Booking Holder Must Be Present

The booking holder must be present during the booking and may be required to verify their identity.

5.3) No Resale, Transfer or Sharing

Bookings must not be resold, assigned, shared, transferred, exchanged, advertised, or used to admit unauthorised persons.

5.4) Restricted Use

Bookings must not be used by banned persons, suspended members, unauthorised commercial operators, unauthorised coaches, or any person refused entry by CBR Badminton.

5.5) Breach of This Clause

Breach of this clause may result in cancellation of the booking without credit or refund, suspension of account access, refusal of entry, termination of membership, or denial of future bookings, except where otherwise required by law.

6. Court Use, Late Arrival and Overstay

6.1) Booked Court and Time Only

Customers must only use the court or courts they have booked, and only during the confirmed booking time.

6.2) Late Arrival

Late arrival does not extend booking time.

6.3) End of Booking

Customers must vacate the court promptly at the end of their booking so the next booking can begin on time.

6.4) Unauthorised Use or Overstay

Unauthorised use of additional courts, use outside the booked time, or overstaying beyond the booked session may result in additional charges. CBR Badminton may charge unauthorised use in minimum 30-minute or 1-hour increments at the applicable casual or peak rate.

6.5) Extensions

Customers wishing to extend a session or add courts must make an additional booking online or obtain approval from reception before continuing play.

6.6) Court Allocation

Court numbers and court allocation are not guaranteed. CBR Badminton may reassign courts where reasonably necessary for operational, safety, maintenance, event, coaching, or programming reasons.

7. Maximum Occupancy Per Court

7.1) Occupancy Limit

Each court booking permits a maximum number of players and spectators as determined by CBR Badminton from time to time.

7.2) Normal Badminton Use

Unless otherwise approved by management, each court booking is intended for normal badminton use only.

7.3) Additional Players or Groups

Additional players, spectators, group rotation, training groups, events, commercial use, or high-occupancy use may require prior approval and may incur additional fees.

7.4) Excessive Occupancy

CBR Badminton may refuse excessive occupancy where it affects safety, comfort, venue capacity, fire safety, customer experience, or normal operations.

8. Cancellation Policy

8.1) General Cancellation Rules

Cancellation rules may vary depending on the type of booking, session, program, event, membership, or promotion.

Customers are responsible for checking the applicable cancellation conditions before confirming a booking.

Unless otherwise stated, cancellations must be made through the CBR Badminton booking system or by contacting CBR Badminton directly.

8.2) Casual Court Bookings

Casual court bookings must be cancelled at least 24 hours before the scheduled booking time.

Cancellations made within 24 hours of the scheduled booking time are considered late cancellations.

8.3) Group Bookings

Group bookings involving three or more courts must be cancelled at least 48 hours before the scheduled booking time.

Cancellations made within 48 hours of the scheduled booking time are considered late cancellations.

8.4) Permanent Bookings, Events and Special Sessions

Permanent bookings, recurring bookings, coaching programs, competitions, private venue hire, corporate bookings, social sessions, events, and special sessions may be subject to separate cancellation terms.

Customers should refer to the specific cancellation terms provided at the time of booking or confirmed by CBR Badminton.

8.5) Late Arrival and No-Shows

Late arrival does not extend the booking time.

No-shows, late arrival, change of mind, lack of players, personal scheduling conflicts, transport issues, weather, or failure to attend do not cancel the booking automatically and do not automatically entitle the customer to any credit, refund, or rescheduling.

8.6) Venue-Initiated Cancellation or Changes

CBR Badminton may cancel, modify, or reschedule a booking where reasonably necessary due to venue closure, court unavailability, safety issues, emergency, maintenance, system error, operational requirements, events, competitions, coaching programs, or other venue-related reasons.

Where this occurs, CBR Badminton will take reasonable steps to notify affected customers and offer a suitable alternative where appropriate.

8.7) Cancellation Due to Misconduct or Breach

CBR Badminton may cancel a booking where a customer breaches these Terms, engages in unsafe or inappropriate behaviour, conducts unauthorised coaching or commercial activity, transfers or resells a booking without approval, misuses the venue, refuses to follow staff directions, damages property, or otherwise disrupts the proper operation of CBR Badminton.

9. Refund and Credit Policy

9.1) General Refund and Credit Rules

Unless otherwise stated, customer-initiated cancellations will generally be handled by account credit rather than cash refund.

No cash refund will be provided for customer-initiated cancellations unless approved by CBR Badminton or required by law.

Eligible credit will generally be applied to the customer's CBR Badminton booking account.

9.2) Credit for Casual Court Bookings

Casual court bookings cancelled at least 24 hours before the scheduled booking time may be eligible for account credit.

Casual court bookings cancelled within 24 hours of the scheduled booking time are not eligible for credit or refund, unless otherwise approved by CBR Badminton or required by law.

9.3) Credit for Group Bookings

Group bookings involving three or more courts cancelled at least 48 hours before the scheduled booking time may be eligible for account credit.

Group bookings cancelled within 48 hours of the scheduled booking time are not eligible for credit or refund, unless otherwise approved by CBR Badminton or required by law.

9.4) Refunds for Venue-Initiated Cancellations

Where CBR Badminton cancels or materially changes a confirmed booking due to venue closure, court unavailability, emergency, safety issue, maintenance, system error, or other venue-related reason, CBR Badminton will take reasonable steps to provide one or more of the following:

  • A suitable alternative booking time
  • Account credit
  • Refund
  • Another remedy where appropriate or required by law

9.5) No Refund for Late Arrival, No-Show or Change of Mind

Late arrival, no-shows, change of mind, lack of players, personal scheduling conflicts, transport issues, weather, or failure to attend do not automatically entitle the customer to credit, refund, or rescheduling.

9.6) No Refund for Misconduct or Breach of Terms

Where a booking is cancelled, refused, suspended, or terminated due to customer misconduct, breach of these Terms, unauthorised coaching, unauthorised transfer or resale of booking, unsafe behaviour, refusal to follow staff directions, damage to property, or misuse of the venue, CBR Badminton may withhold credit or refund, except where otherwise required by law.

9.7) Payment Fees and Surcharges

Payment processing fees, card surcharges, online transaction charges, booking platform fees, or administrative fees may be non-refundable where permitted by law.

9.8) Stored Credit

Account credit is not cash and cannot be redeemed for cash unless required by law.

Account credit may only be used for approved CBR Badminton services and may be subject to expiry dates, usage limits, or other conditions notified by CBR Badminton.

9.9) Australian Consumer Law

Nothing in this Refund and Credit Policy excludes, restricts, or modifies any rights, guarantees, remedies, or protections that customers may have under the Australian Consumer Law or any other applicable law.

10. Permanent and Recurring Bookings

10.1) Approval

Permanent or recurring bookings may be offered at CBR Badminton's discretion and are subject to availability, approval, payment terms, and ongoing compliance with these Terms.

10.2) No Ownership of Court

Permanent bookings do not grant ownership of a court, guaranteed court number, exclusive venue rights, or unlimited access.

10.3) Review or Modification

CBR Badminton may review, modify, suspend, or terminate permanent bookings where reasonably necessary for operational requirements, pricing updates, events, competitions, coaching programs, misuse, non-payment, or breach of these Terms.

10.4) Ongoing Compliance

Permanent booking customers must comply with all payment schedules, cancellation rules, conduct standards, and venue policies.

11. Membership Terms

11.1) Membership Approval

Membership applications are subject to approval by CBR Badminton.

11.2) Membership Benefits

Membership benefits, pricing, booking windows, discounts, priority access, credit systems, rewards, and other member privileges may vary from time to time.

11.3) Personal Membership

Membership is personal to the approved member and must not be transferred, shared, resold, or used by another person.

11.4) Misuse of Benefits

Members must not allow non-members to misuse member benefits, discounted rates, booking privileges, account access, QR codes, access credentials, or membership entitlements.

11.5) Suspension, Cancellation or Refusal

CBR Badminton may suspend, cancel, or refuse membership where a member:

  • Breaches these Terms
  • Misuses membership benefits
  • Shares or transfers membership access
  • Engages in unsafe, abusive, disruptive, dishonest, or inappropriate behaviour
  • Harasses staff, customers, coaches, players, or visitors
  • Engages in unauthorised coaching, commercial training, client solicitation, promotional activity, or competing business activity within the venue
  • Damages property
  • Fails to pay amounts owed
  • Uses the venue in a way that affects the proper operation, safety, reputation, or customer experience of CBR Badminton

11.6) Remaining Credit or Benefits

Any account credit, prepaid balance, or membership benefit remaining at the time of suspension or termination will be handled in accordance with the relevant membership terms, booking terms, and applicable law.

12. Prepaid Credit, Account Balance and Stored Value

12.1) Use of Credit

Where CBR Badminton offers prepaid credit, stored value, top-up credit, bonus credit, or account balance systems, the following terms apply unless otherwise stated:

  • Credit may only be used for approved CBR Badminton services
  • Credit is not cash and cannot be redeemed for cash
  • Credit is non-refundable unless required by law
  • Bonus credit, promotional credit, rewards, or complimentary credit may be subject to expiry dates, usage limits, and special conditions
  • Credit must not be transferred, sold, exchanged, or assigned without prior approval from CBR Badminton

12.2) Suspension or Cancellation of Credit

CBR Badminton may suspend or cancel access to credit where there is fraud, misuse, chargeback abuse, payment dispute, breach of these Terms, or unauthorised account sharing.

12.3) Account Security

Customers are responsible for keeping their account login, booking access, and payment details secure.

13. Health, Safety and Assumption of Risk

13.1) Inherent Risks

Badminton, physical exercise, training, social sport, competition, and use of indoor sporting facilities involve inherent risks.

13.2) Risk Acknowledgement

By entering the venue or participating in any activity at CBR Badminton, you acknowledge and accept that these risks may include, but are not limited to:

  • Slips, trips, and falls
  • Muscle strains, sprains, cramps, or fatigue
  • Twisted ankles, knee injuries, shoulder injuries, or other sporting injuries
  • Collision with other players, equipment, walls, posts, nets, or objects
  • Being struck by a racquet, shuttlecock, equipment, or another person
  • Aggravation of pre-existing medical conditions
  • Dizziness, asthma, breathing difficulty, fainting, cardiac events, or other medical episodes
  • Injury arising from overexertion or unsafe participation

13.3) Personal Responsibility

Each person is responsible for assessing their own health, fitness, physical condition, skill level, and ability to safely participate.

13.4) Alcohol, Drugs, Illness and Injury

You must not participate if you are affected by alcohol, drugs, illness, serious injury, or any medical condition that may make participation unsafe.

13.5) Serious Medical Conditions

Participation is not recommended for people with serious medical conditions, including but not limited to epilepsy, heart disease, severe respiratory conditions, recent major illness, or serious injury, unless medical advice has been obtained.

13.6) Pregnancy, Illness or Injury Recovery

Pregnant customers or customers recovering from illness or injury should seek medical advice before participating.

13.7) Limitation of Liability for Inherent Risks

To the maximum extent permitted by law, CBR Badminton is not liable for injury, loss, damage, or medical conditions arising from the inherent risks of badminton, physical activity, or use of the venue, except where liability cannot be excluded under applicable law.

14. Customer Conduct

14.1) General Conduct

All customers, players, spectators, visitors, members, parents, guardians, coaches, and organisers must behave responsibly, respectfully, and safely at all times.

14.2) Customer Obligations

You must:

  • Follow all reasonable directions from CBR Badminton staff and management
  • Follow all signs, safety rules, and venue instructions
  • Treat staff, customers, players, coaches, spectators, and visitors with respect
  • Use facilities and equipment only as intended
  • Avoid behaviour that may harm, intimidate, harass, offend, endanger, or disrupt others
  • Respect neighbouring businesses, shared spaces, car parks, and surrounding areas
  • Leave the venue clean and orderly

14.3) Behaviour Not Tolerated

The following behaviour is not tolerated:

  • Abuse, threats, aggression, intimidation, harassment, bullying, discrimination, or offensive language
  • Unsafe play or reckless behaviour
  • Fighting, pushing, throwing equipment, or deliberate dangerous conduct
  • Damaging or misusing property
  • Refusing to leave a court or venue area when directed
  • Disrupting other bookings, events, coaching sessions, or operations
  • Misusing the booking system or entry system
  • Impersonating another person
  • Providing false or misleading information
  • Entering restricted areas without permission
  • Any unlawful conduct

14.4) Consequences

CBR Badminton may refuse entry, remove a person, cancel bookings, suspend accounts, terminate membership, or report matters to authorities where appropriate.

15. Clothing, Footwear and Court Protection

15.1) Appropriate Sporting Attire

Appropriate sporting attire must be worn at all times.

Shirts must be worn on and off court at all times.

15.2) Badminton-Specific Court Flooring

CBR Badminton uses professional badminton-specific court flooring designed to provide strong grip, traction, and performance support for badminton movements.

The professional playing environment may encourage faster movement, sharper changes of direction, quicker reactions, lateral movements, backward movements, and higher-intensity play.

15.3) Badminton Shoes Requirement

To reduce the risk of accidental injury, including slips, trips, falls, ankle injuries, knee injuries, and other movement-related injuries, all players must wear proper badminton shoes specifically designed for badminton.

Only clean, non-marking badminton shoes are permitted on court.

15.4) Footwear Not Permitted on Court

The following are not permitted on court:

  • Outdoor shoes
  • Dirty shoes
  • Marking soles
  • Running shoes
  • Casual sneakers
  • General indoor sports shoes not specifically designed for badminton
  • Shoes with sole patterns unsuitable for badminton movement
  • Shoes without sufficient lateral support
  • Shoes not designed to support rapid side-to-side movement, lunging, stopping, and backward movement
  • Heeled shoes
  • Leather-soled shoes
  • Work boots
  • Bare feet
  • Footwear that may damage the floor, reduce player stability, or create a safety risk

15.5) Right to Refuse Court Access

CBR Badminton may refuse court access where footwear, clothing, or equipment may damage the flooring, reduce safety, increase injury risk, create operational issues, or affect the customer experience.

15.6) Customer Responsibility

Customers are responsible for ensuring that their footwear is appropriate for badminton play and for their own movement, balance, and physical safety.

Customers are also responsible for any damage caused to court surfaces, flooring, mats, walls, fixtures, equipment, or facilities by inappropriate footwear, misuse, negligence, or unauthorised equipment.

16. Food, Drinks, Smoking, Vaping and Alcohol

16.1) Food on Court

No food is permitted on court.

16.2) Drinks on Court

No drinks are permitted on court except water in sealed bottles.

16.3) Approved Eating Areas

Food may only be consumed in designated seating, lounge, reception, or approved areas.

16.4) Restricted Areas

Customers must keep food, drinks, rubbish, and personal items away from court surfaces, walkways, emergency exits, and restricted areas.

16.5) Smoking, Vaping, Alcohol and Illegal Substances

Smoking, vaping, alcohol consumption, and illegal substances are strictly prohibited inside CBR Badminton.

16.6) Affected Customers

Customers affected by alcohol or drugs may be refused entry, removed from the venue, or prevented from participating.

17. Cleanliness and Rubbish

17.1) Court Cleanliness

Customers must leave their court and surrounding area clean and ready for the next users.

17.2) Rubbish

All rubbish must be placed in bins provided.

17.3) Used Shuttlecocks

Used shuttlecocks must be placed in designated shuttle collection baskets where available.

17.4) Items Left on Court

Customers must not leave food, drink containers, tape, broken shuttlecocks, packaging, personal items, or rubbish on court or in surrounding areas.

17.5) Cleaning Fees

Excessive mess, damage, or cleaning caused by a customer or group may result in cleaning fees or other reasonable charges.

18. Children, Parents and Guardians

18.1) Responsibility for Children

Parents, guardians, coaches, or responsible adults are responsible for the care, supervision, safety, and behaviour of children in their care while at CBR Badminton.

18.2) Supervision

Children must be supervised at all times unless they are participating in an approved CBR Badminton coaching program or supervised activity.

18.3) Unsafe Behaviour by Children

Children must not run through courts, enter active playing areas unsafely, interfere with bookings, play with equipment without permission, climb on furniture, misuse facilities, or enter restricted areas.

18.4) Damage or Misconduct

Parents, guardians, or organisers are responsible for any damage, injury, disruption, or misconduct caused by children under their supervision.

18.5) Child Safety Requirements

Where activities involve minors, all relevant child safety, Working With Vulnerable People, Working With Children, or equivalent legal requirements must be complied with.

19. External Coaching, Training and Commercial Activity

19.1) Written Approval Required

No person may conduct private coaching, group training, clinics, camps, school programs, paid instruction, commercial training, player recruitment, organised sessions, or any other commercial activity at CBR Badminton without prior written approval from management.

19.2) Application

This applies whether the activity is for adults, children, members, non-members, private groups, clubs, schools, organisations, social groups, or commercial operators.

19.3) Unauthorised Coaching or Commercial Activity

Unauthorised coaching or commercial activity includes, but is not limited to:

  • Charging players for coaching or training
  • Promoting coaching services
  • Recruiting students or clients
  • Running group sessions without approval
  • Using personal or third-party branding to advertise training
  • Using CBR Badminton facilities to operate or promote a competing business
  • Booking courts under a personal name for commercial training
  • Conducting private lessons without approval
  • Advertising sessions held at CBR Badminton without permission

19.4) Approved External Coaches or Organisers

Approved external coaches, organisers, or organisations must:

  • Obtain written approval before conducting activities
  • Make and pay for all required bookings in advance
  • Comply with CBR Badminton rules, codes of conduct, and operational requirements
  • Hold appropriate insurance where required
  • Comply with all child safety obligations where minors are involved
  • Ensure all participants follow CBR Badminton rules
  • Clearly identify themselves as the provider of the training or service
  • Not imply endorsement, partnership, employment, or affiliation with CBR Badminton unless expressly approved in writing

19.5) Consequences of Unauthorised Activity

CBR Badminton reserves the right to cancel, suspend, or deny bookings, refuse entry, or terminate future access for any person or organisation conducting unauthorised coaching, training, recruitment, or commercial activity.

20. Events, Competitions and Group Activities

20.1) Approval Required

Events, competitions, tournaments, social sessions, corporate bookings, group activities, school programs, community events, and private venue hire are subject to CBR Badminton approval.

20.2) Special Conditions

Special conditions may apply to these activities, including:

  • Different pricing
  • Different cancellation terms
  • Additional deposits or prepayment
  • Insurance requirements
  • Staffing requirements
  • Cleaning fees
  • Security requirements
  • Participant limits
  • Photography or filming conditions
  • Sponsorship or advertising restrictions
  • Child safety requirements

20.3) Right to Cancel, Modify or Refuse

CBR Badminton may cancel, modify, or refuse any event or group activity where reasonably necessary for safety, operational, legal, reputational, or venue management reasons.

21. Advertising, Sponsorship, Photography, Filming and Commercial Rights

21.1) Venue Commercial Rights

CBR Badminton owns and controls all advertising, sponsorship, signage, promotional, filming, photography, livestreaming, media, and commercial activation rights within the venue.

21.2) Commercial Filming and Promotion

No person may conduct commercial filming, photography, livestreaming, advertising, sponsorship activation, promotional activity, brand display, product demonstration, media production, influencer campaign, or commercial content creation at CBR Badminton without prior written approval.

21.3) Promotional Materials

No person may display banners, posters, business cards, QR codes, flyers, branded materials, merchandise, signage, sponsor logos, or promotional material without prior approval.

21.4) Use of CBR Badminton Identity

No person may use the name, logo, brand, image, interior design, facilities, courts, or identity of CBR Badminton in advertising, promotion, social media, websites, events, or commercial communication without prior written approval.

21.5) Personal Photography or Video

Casual personal photography or video for private, non-commercial use may be permitted, provided it does not interfere with other customers, capture people without appropriate consent, breach privacy, create safety risks, or affect venue operations.

21.6) Right to Stop Filming or Promotion

CBR Badminton may request that any photography, filming, livestreaming, or promotional activity stop immediately.

22. CBR Badminton Photography and Media Use

22.1) Photography and Videography

Photography and videography may occur during events, competitions, social sessions, coaching programs, promotional activities, media days, or venue operations.

22.2) Incidental Appearance

By entering or participating in such activities, customers acknowledge that they may appear incidentally in photography or video footage.

22.3) Use of Approved Media

CBR Badminton may use photos and videos taken at approved events or activities for promotional, marketing, social media, website, internal, or archival purposes, subject to applicable privacy laws and any specific consent requirements.

22.4) Opt-Out Request

Customers who do not wish to be photographed or filmed should notify CBR Badminton staff before participation.

22.5) Minors

Additional consent may be required for minors.

22.6) Practical Limitations

CBR Badminton will take reasonable steps to respect privacy requests where practicable, but cannot guarantee exclusion from all incidental background footage in public or event settings.

23. External Equipment

23.1) Prior Approval Required

No external equipment may be brought onto court or used within the venue without prior approval from CBR Badminton where that equipment may affect safety, flooring, operations, other customers, or venue property.

23.2) Examples of External Equipment

This includes, but is not limited to:

  • Shuttle machines
  • Ball machines
  • Training equipment
  • Ladders
  • Tripods
  • Lighting stands
  • Camera rigs
  • Speakers
  • Microphones
  • Trolleys
  • Furniture
  • Heavy bags
  • Fitness equipment
  • Markers, cones, tape, or floor attachments
  • Any item that may contact, scratch, mark, dent, or damage the floor

23.3) Right to Refuse or Remove Equipment

CBR Badminton may refuse, restrict, remove, or require modification of any external equipment.

23.4) Customer Responsibility

Customers are responsible for all damage, injury, cleaning, repair, or replacement costs arising from unauthorised or unsafe equipment use.

24. Equipment Hire and Retail

24.1) Availability

CBR Badminton may offer equipment hire, retail products, restringing, or other pro shop services from time to time.

24.2) Payment and Return

Hire equipment must be paid for before use and returned in good condition before leaving the venue.

24.3) Equipment Must Remain Onsite

Hire equipment must not be taken outside the venue unless expressly approved.

24.4) Loss or Damage

Customers are responsible for loss, theft, misuse, or damage to hire equipment.

24.5) Replacement or Repair Costs

Lost or damaged equipment may be charged at replacement value, repair cost, or the applicable retail price.

24.6) Normal Wear and Tear

Normal wear and tear may be excluded at CBR Badminton's discretion.

24.7) Rental Racquet Strings

If a rental racquet string breaks during normal use, CBR Badminton may provide a replacement racquet where available. Damage caused by misuse, impact, deliberate abuse, or negligent handling may be charged to the customer.

24.8) Retail and Pro Shop Services

Retail sales, restringing, and other product or service purchases may be subject to separate terms, supplier warranties, consumer guarantees, and return policies.

25. Property Damage, Cleaning and Liability for Costs

25.1) Customer Responsibility

Customers are responsible for any damage, loss, excessive cleaning, repair, replacement, call-out fee, administrative cost, or business interruption caused by them, their guests, children, players, spectators, invitees, coaches, organisers, contractors, or group participants.

25.2) Examples of Property

This includes damage to:

  • Courts
  • Flooring
  • Mats
  • Timber subfloor
  • Nets and posts
  • Walls
  • Lighting
  • Furniture
  • Bathrooms
  • Doors
  • Locks
  • Access systems
  • CCTV
  • Fire safety systems
  • Emergency equipment
  • Retail products
  • Hire equipment
  • Signage
  • Car park or external areas
  • Any other CBR Badminton property or third-party property

25.3) Recovery of Costs

CBR Badminton may charge reasonable repair, replacement, cleaning, call-out, administrative, or recovery costs.

25.4) Serious Damage or Misconduct

Where damage or misconduct is serious, CBR Badminton may also suspend access, cancel bookings, terminate membership, refuse future service, or report the matter to relevant authorities.

26. Emergency and Safety Equipment

26.1) Emergency Use Only

Emergency equipment, fire safety equipment, alarms, hydrants, extinguishers, emergency exits, exit doors, safety signage, and related safety systems are for emergency use only.

26.2) No Tampering or Misuse

Any unauthorised use, interference with, tampering with, obstruction, damage, or misuse of emergency or safety equipment is strictly prohibited.

26.3) Financial Liability

Any person responsible for unauthorised use or misuse that causes damage, loss, water damage, flooding, call-out fees, cleaning costs, repair costs, replacement costs, business interruption, emergency service charges, insurance excess, or other costs may be held financially liable.

26.4) Reporting to Authorities

CBR Badminton may report unauthorised use, tampering, obstruction, or damage of emergency equipment to relevant authorities.

26.5) No Obstruction

Emergency exits, fire doors, hydrants, extinguishers, switchboards, access panels, and safety equipment must not be blocked, covered, locked, moved, misused, or obstructed by customers.

27. Personal Belongings

27.1) Customer Responsibility

Customers are responsible for their own belongings at all times.

27.2) No Responsibility for Personal Property

CBR Badminton is not responsible for lost, stolen, misplaced, forgotten, damaged, or unattended personal property, except where liability cannot be excluded by law.

27.3) Valuables

Customers should not leave valuables unattended.

27.4) Lost Property

Lost property may be held for a limited period and then disposed of, donated, or otherwise handled at CBR Badminton's discretion.

27.5) Items Left at Venue

CBR Badminton is not responsible for items left in courts, seating areas, bathrooms, car parks, pro shop areas, lockers, or any other part of the venue.

28. Parking, Neighbours and Shared Areas

28.1) Parking Availability

Parking may be available onsite or in nearby public areas, subject to signage, availability, restrictions, and neighbouring property rights.

28.2) Parking Rules

Customers must park only in permitted areas and must not block driveways, loading zones, emergency access, neighbouring businesses, reserved bays, shared access points, footpaths, or vehicle movement areas.

28.3) Compliance With Signs and Directions

Customers must comply with all parking signs, road rules, property signs, and lawful directions from management, property managers, authorities, or neighbouring businesses.

28.4) No Responsibility for Vehicles

CBR Badminton is not responsible for parking fines, towing, vehicle damage, theft, or loss involving vehicles or items left in vehicles.

28.5) Neighbours and Shared Areas

Customers must be respectful of neighbouring businesses, residents, and shared areas. Excessive noise, littering, loitering, unsafe driving, or disruptive behaviour in car parks or external areas may result in refusal of service or cancellation of bookings.

29. Access to the Venue, Access Credentials and Security

29.1) Authorised Access Only

Customers must only access CBR Badminton during approved opening hours, booking times, events, or authorised sessions.

29.2) Security Systems

Security systems, access control systems, smart locks, booking-linked entry systems, alarms, and CCTV may operate within the venue.

29.3) Access Credentials

Access credentials, QR codes, PINs, cards, keys, fobs, app access, membership access, or booking-linked entry permissions are personal and must not be shared, transferred, copied, resold, or used to admit unauthorised persons.

29.4) Prohibited Access Behaviour

Tailgating, propping doors open, bypassing access systems, sharing entry credentials, entering outside approved times, or assisting unauthorised access is strictly prohibited.

29.5) Consequences

CBR Badminton may suspend access, cancel bookings, terminate membership, charge costs, or report unauthorised access to authorities where appropriate.

30. CCTV and Security Monitoring

30.1) CCTV Use

CCTV operates throughout CBR Badminton for safety, security, incident management, asset protection, customer protection, staff protection, and operational purposes.

30.2) Private Areas

CCTV does not operate in private areas such as bathrooms, toilets, or change rooms.

30.3) Acknowledgement

By entering the venue, customers acknowledge that they may be recorded by CCTV.

30.4) Review of Footage

CCTV footage may be reviewed by authorised management, security providers, insurers, legal advisers, property managers, or authorities where reasonably necessary for safety, security, legal, insurance, dispute resolution, or incident management purposes.

30.5) Privacy Obligations

CBR Badminton will take reasonable steps to manage CCTV footage in accordance with applicable privacy obligations and CBR Badminton's Privacy Policy.

30.6) Unauthorised Access

Unauthorised access to CCTV systems, security systems, access systems, alarms, or network systems is strictly prohibited.

31. Privacy Policy

31.1) Separate Privacy Policy

CBR Badminton handles personal information in accordance with its Privacy Policy, which is available on the CBR Badminton website or upon request.

31.2) Acknowledgement

By making a booking, creating an account, entering the venue, participating in programs or events, communicating with CBR Badminton, or using CBR Badminton services, customers acknowledge that their personal information may be collected, used, stored, disclosed, and managed in accordance with the Privacy Policy.

31.3) Personal Information

Personal information may include information collected through bookings, memberships, payments, communications, CCTV, access systems, incident records, programs, events, marketing communications, and other customer interactions.

31.4) Privacy Enquiries

Customers may contact CBR Badminton to request access to, correction of, or further information about their personal information, or to make a privacy enquiry or complaint.

31.5) Inconsistency

To the extent there is any inconsistency between these Terms and the Privacy Policy regarding the handling of personal information, the Privacy Policy will apply to the handling of personal information.

32. Website, Booking System and Electronic Communication

32.1) No Guarantee of Uninterrupted Systems

CBR Badminton does not guarantee that its website, booking system, payment system, communication channels, or digital services will be uninterrupted, error-free, secure, or always available.

32.2) Errors and Inaccuracies

From time to time, information on the website, booking system, emails, social media, signage, or other communications may contain typographical errors, inaccuracies, omissions, incorrect pricing, incorrect availability, or system errors.

32.3) Correction of Errors

CBR Badminton reserves the right to correct obvious errors, update information, modify bookings, cancel transactions, or contact affected customers to offer a reasonable alternative, credit, refund, or correction where appropriate.

32.4) Electronic Communication Risks

Customers acknowledge that electronic communications, online bookings, and payment systems may involve security risks. Customers are responsible for keeping login details, account details, and payment information secure.

32.5) Customer Errors

CBR Badminton is not responsible for customer errors, including incorrect booking details, incorrect contact information, duplicate bookings, mistaken dates, mistaken times, or use of the wrong account.

33. Prohibited Uses

33.1) Prohibited Conduct

Customers must not use the CBR Badminton website, booking system, premises, services, facilities, social platforms, or communication channels for:

  • Any unlawful purpose
  • Harassment, abuse, threats, intimidation, defamation, discrimination, or harm
  • Providing false or misleading information
  • Impersonating another person
  • Misusing bookings, memberships, or access systems
  • Reselling or transferring bookings without approval
  • Admitting unauthorised persons
  • Unauthorised coaching, training, recruitment, promotion, or commercial activity
  • Uploading, sending, or distributing viruses, malware, spyware, or malicious code
  • Attempting to access, interfere with, scrape, crawl, copy, bypass, hack, or compromise any booking, security, payment, website, CCTV, access, or IT system
  • Collecting or tracking personal information of others without consent
  • Spam, phishing, fraud, or deceptive conduct
  • Offensive, obscene, immoral, or harmful purposes
  • Any activity that interferes with safety, venue operations, customer experience, or the rights of others

33.2) Consequences

CBR Badminton may suspend or terminate access to services where prohibited use occurs.

34. Pets and Animals

34.1) Animals Not Permitted

Pets and animals are not permitted inside CBR Badminton, except for assistance animals where required by law.

34.2) Assistance Animals

Customers bringing an assistance animal must ensure the animal remains under control and does not create safety, hygiene, operational, or customer wellbeing issues.

35. Intellectual Property

35.1) Ownership

All CBR Badminton names, logos, trade marks, designs, branding, signage, written materials, policies, website content, social media content, photography, video, program materials, training materials, event concepts, documents, visual identity, and other intellectual property remain the property of CBR Badminton or its licensors.

35.2) No Unauthorised Use

Customers must not copy, reproduce, publish, distribute, adapt, use, or commercially exploit CBR Badminton intellectual property without prior written permission.

35.3) No Implied Endorsement

No person may use the CBR Badminton name, logo, venue image, court image, brand identity, or association with CBR Badminton in any way that suggests sponsorship, endorsement, partnership, employment, affiliation, or approval without written consent.

36. User Comments, Feedback and Submissions

36.1) Permission to Use Submissions

If a customer provides feedback, suggestions, ideas, comments, reviews, testimonials, photos, videos, competition entries, social media tags, or other submissions to CBR Badminton, the customer grants CBR Badminton permission to use, reproduce, edit, publish, translate, display, distribute, and share those submissions for business, promotional, internal, or operational purposes, unless otherwise agreed in writing.

36.2) Prohibited Content

Customers must not submit content that is unlawful, defamatory, abusive, misleading, offensive, discriminatory, infringing, confidential, harmful, or containing viruses or malicious software.

36.3) Responsibility for Content

Customers are responsible for the accuracy and legality of any content they submit.

36.4) Moderation

CBR Badminton may remove, moderate, edit, or refuse to publish content at its discretion.

37. Third-Party Links, Products and Services

37.1) Third-Party Services

CBR Badminton may provide links, referrals, products, services, or information involving third parties, including suppliers, booking platforms, payment processors, event partners, sponsors, coaches, retailers, or other businesses.

37.2) No Responsibility for Third Parties

CBR Badminton is not responsible for the content, policies, products, services, pricing, accuracy, availability, or conduct of third-party websites or providers, except where required by law.

37.3) Customer Responsibility

Customers should review applicable third-party terms, policies, and warranties before engaging with third-party services.

38. Disclaimers and Limitation of Liability

38.1) Services Provided As Available

To the maximum extent permitted by law, CBR Badminton provides its services, facilities, products, website, booking system, programs, and venue access on an “as available” basis.

38.2) No Guarantee

CBR Badminton does not guarantee that:

  • Services will be uninterrupted, error-free, or always available
  • Courts will always be available at preferred times
  • Specific court numbers will be guaranteed
  • Results from coaching, training, or participation will meet customer expectations
  • Website, booking, access, payment, or communication systems will be free from errors or interruptions

38.3) Limitation of Liability

To the maximum extent permitted by law, CBR Badminton and its directors, officers, employees, contractors, coaches, agents, suppliers, and service providers are not liable for indirect, incidental, special, consequential, punitive, or economic loss, including loss of profit, loss of opportunity, loss of data, loss of goodwill, loss of revenue, business interruption, or replacement costs.

38.4) Non-Excludable Rights

Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, remedies, or protections that cannot be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law.

38.5) Maximum Extent Permitted by Law

Where CBR Badminton's liability cannot be excluded but may be limited, CBR Badminton's liability is limited to the maximum extent permitted by law.

39. Australian Consumer Law

39.1) Consumer Guarantees

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, remedy, or protection that you may have under the Australian Consumer Law or other applicable legislation.

39.2) Severability

If any part of these Terms is found to be invalid, unlawful, unfair, or unenforceable, that part will be read down or severed to the extent necessary, and the remaining Terms will continue to apply.

40. Suspension, Termination and Outstanding Amounts

40.1) Suspension or Termination

CBR Badminton may suspend, restrict, or terminate a customer's access, account, booking privileges, membership, or future bookings where the customer breaches these Terms, fails to pay amounts owed, misuses services, engages in misconduct, or where reasonably necessary for safety, security, operational, or venue management purposes.

40.2) Existing Rights and Obligations

Termination or suspension does not affect any rights, obligations, or liabilities that arose before the date of suspension or termination.

40.3) Outstanding Amounts

Customers remain liable for all outstanding amounts owed to CBR Badminton, including booking fees, damage costs, cleaning costs, equipment replacement, unpaid charges, administrative costs, or other amounts properly payable.

40.4) Refusal of Future Services

CBR Badminton may refuse future bookings or services until outstanding amounts are paid.

41. Entire Agreement

41.1) Entire Agreement

These Terms, together with any booking conditions, membership terms, event terms, coaching terms, posted venue rules, website policies, Privacy Policy, or written policies provided by CBR Badminton, form the entire agreement between the customer and CBR Badminton in relation to use of the venue and services.

41.2) No Waiver

Failure by CBR Badminton to enforce any part of these Terms does not constitute a waiver of its rights.

41.3) Interpretation

Any ambiguity in these Terms will not automatically be interpreted against CBR Badminton as the drafting party.
